Driving Under the Influence (DUI)

In Georgia, any person who operates a motor vehicle (including cars, trucks, motorcycles, boats, and other vehicles) on public roads or waterways with a blood-alcohol content (BAC) of .08 or more, or under the influence of drugs, may be charged with "driving under the influence" (DUI).

A DUI conviction will usually result in a significant monetary fine, and may result in a jail term and suspension of your driver's license.  In addition, you may face other hardships, including much higher future car insurance rates, and possible loss or denial of state-issued professional licenses.

If you are charged with driving under the influence of alcohol or drugs (DUI), an experienced attorney can help you protect your legal rights. 

If you were charged as a result of a BAC test with a reading of .08 or more, you must take action within 10 business days, or your driver's license will be automatically suspended, even though you have not yet been convicted.

You are entitled to have all evidence collected by law enforcement officials disclosed to you and your attorney before any trial.  Frequently, this evidence also includes information that may help you. 

Any testimony or other evidence against you that has been improperly obtained, or tainted, may be prevented from being used against you in court.  Many DUI cases are dismissed as a result of an improper vehicle stop, or failure by an arresting officer to conform to state-mandated guidelines for DUI arrests.        

If you are convicted, you may petition the court to avoid suspension of your driver's license, if your BAC test result is below .15, and you have not been convicted of a similar offense in the previous five years.
