Divorce


The decision to file for divorce is, understandably, a difficult one.  In order to file for divorce in Georgia, you must have lived in the state for at least six (6) months. It does not matter where you were married.

You may be granted a divorce even if your spouse:

  • Cannot be located,
  • Does not live in the state, or
  • Refuses to participate in divorce proceedings.

Issues of child custody, child support, alimony, and division of marital property and assets are all handled as part of divorce proceedings. 

Divorces may be contested or uncontested. In an uncontested divorce, the parties are able to reach agreement on all issues, and the legal process is greatly simplified and expedited.  Contested divorces are often limited to one or two minor issues or may involve substantial disagreement between the parties.
