Ten Day DUI Rule

What is the 10-Day Rule?

If you are pulled over and suspected of driving under the influence and if you refuse to take a urine, breath or blood test you are automatically charged with a DUI. If you take a breath test and the results are over (0.8) the legal limit, an administrative license suspension under Georgia's Administrative License Suspension Law (ALS) is applicable. You will only have 10 business days after you receive your ticket to request a special hearing or you license will be suspended for one year.

When does the 10-Day Rule apply?

  • You refused to take a blood, breathe or urine test
  • You tested over the legal limit of 0.08
  • You are under 21 and your test result results were .02 or higher
  • You have a CDL and your blood alcohol level was .04 or higher
