Duluth Drug Charges Attorneys
With Additional Offices in Covington and Lawrenceville
Possessing even small amounts of illegal drugs is a crime with significant penalties. At The Wren Law Firm, our Georgia lawyers defend clients against drug possession charges. We have been defending individuals against drug charges since 1993, and have the experience skill and knowledge to effectively represent clients in Superior and State Court.
Drug Possession Penalties
Drug possession penalties depend on the drug and amount involved, and whether the defendant has prior convictions. Moreover, if the prosecution can prove intent to distribute, the consequences increase. For example, a person convicted on state charges of possession of heroin could receive a mandatory minimum prison sentence of two to 15 years, depending on all the factors. The penalty for possession of certain prescription drugs is less, from one to five years in prison. Drug cultivation or manufacture penalties range from five to 15 years. The penalties are enhanced if the defendant can be shown to have possessed the drug near a school or other prohibited location.
A defendant faces additional penalties such as loss of job, inability to carry a firearm, loss of driver's license and property forfeiture. They will have criminal records for life. The stakes are high, and it is worth retaining an experienced drug possession defense lawyer.
How We Help
We investigate the circumstances of the arrest. Did the police have a warrant to search the home or car? Did they properly warn the defendant of his or her rights? Did they correctly complete the required paperwork?
We also determine whether the charge fits the facts of the matter. Did our client actually have the drugs under his or her control? Was the amount of the drug correctly calculated?
We force the prosecution to prove its case in court. However, when the circumstances are not favorable for our client, we are skilled negotiators, seeking reduced charges that limit the damage to his or her future and freedom.
